To explain it in further, it can be seen that in Islamic law of contract, the contract of sale must clearly mentioned the object of contract and if it is not specified then it will not be included. By looking at this ruling, we can make a direct analogy (qiyas jali) between sale and waqf because both involve in transfer of ownership. Thus, it can be conclud ed that if the additional rights had been explicitly stated in the waqf then only it will be included in the waqf but if it does not explicitly stated in the waqf then it will not be included in the waqf. The issue that arise is that this direct analogy (qiyas jali) if being followed, it will lead us to unequitable results where the waqf of cultured lands that are without its additional or ancillary rights would prevent the essential rationale of waqf which is to ease the use of property for charitable purposes. Therefore, in order to avoid this hardship, an alternative analogy should be taken into account where it is called qiyas khafi (istihsan). In this case, the qiyas khafi is to draw similarity with the contract of lease (ijarah) and not with contact of sale. Both ijarah and waqf can be compared to each other because both also involve the transfer of usufruct. By using the alternative analogy, it can be said that waqf is included even without explicitly specify the ancillary ri ghts of the property[6]. Other than that, there is another type of istihsan which is called as exceptional istihsan (istihsanistithnaà ¢Ã¢â€š ¬Ã¢â€ž ¢i) where the role of this type of istihsan is to make an exception to the general rule of the present law when the jurist believed that by making such exception, justice and equity will be uphold better. The decision that the jurist had made is as a result of the jurist personal ijtihad or the exception had been supported by the nass (Al-Quran and Sunnah), ijmaà ¢Ã¢â€š ¬Ã¢â€ž ¢, approved custom, necessity (darurah), or considerations of public interest (maslahah)[7]. One of the example of exceptional istihsan that had been supported by the Al-Quran is regarding bequests to relatives ( Surah Al-Baqarah 2: 180). This Quranic verse signifies the exception from the general rule of Shariah where that a bequest (inheritance) is basically not valid because bequest controls the partition of the land once the testator had died and the n ew rule do not allow the act of quicken the process of bequest. Water in a well cannot be used for ablution if it has been polluted by impure substances and the water in the well also cannot be purified by removing the part which is impure. It also cannot be poured either because of the continuous contact with the water that flows in the well. In order to solve this matter, it had been found through istihsa n where wells that had been contaminated can be cleansed by eliminating particular amount containers of water from the well. The precise amount of containers of water that should be eliminated from the contaminated well will be determined by looking at the type and the intensity of pollution that had been made. In 20 lines Shakespeare is able to write an excellent ending to his play, while speaking through his characters about Shakespeare's own life and career. Even more amazingly, he seemlessly ties the two together. In the context of the story Prospero's monologue makes perfect sense. He has lost his magical power, so his "charms are o'erthrown, and what strength [Prospero] have's [his] own, which is most faint." He is now "confined" on the Island, for his other choice would be to go to Naples and reclaim his dukedom, but he doesn't want to do that because he has already "pardoned the deceiver" who took his position many years ago. Prospero then says something a little strange, but it makes sense in the context of the story, he ask us to "release [him] from [his] bands with the help of your good hands." In other words, clap so that the sails of the boats his friends are riding in will be safely returned and Prospero can be "relieved by prayer" of the audience. All of what Prospero has said is very nice cute, but the most interesting part of this monologue is what Shakespeare himself is saying. "Now that my charms are all o'erthrown, and what strength I have's mine own" means, now my plays are over, and it's no longer my characters speaking. The "Island" or stage Shakespeare is on is now "bare" and it is time for "you" the audience to release Shakespeare and his actors from this play with the "help of [y]our good hands." Shakespeare was not only being released for the performance of the play, he was being release from his career as a playwright. But there are more reasons to clap besides the obvious reason that the play is over, Shakespeare could not allow his final play to be bad, his project "was to please." He reiterates this point by saying "and my ending is despair unless I be relieved by prayer", or the clapping of the audience and it frees "all faults" and allows Shakespeare to indulge the clapping and joy of the au dience. The third key is to know how the institution's revenue is generated. Physicians are the key to revenue, and management should be actively involved in physician service, retention, and recruitment. This will allow management to accurately predict volume from admissions and subsequent revenue. The fourth key is to base the budgets on reasonable objectives. Scanlan discusses basing budget numbers on realistic achievements, rather than â€Å"what the boss wants.† The budget should have specific action steps, responsibility, and timelines and milestones so that progress can be monitored and corrective action taken when needed. The fifth key deals with keeping the operating margin healthy. The margin must be realistic and as accurate as possible. â€Å"Without a rigorous approach to establishing a realistic operating margin, the CEO, CFO, and management team may face a daunting shortfall of budgeted margin to meet cash requirements.†1 The sixth key is to monitor the process. Actual results must be captured and variances generated when there is a difference between the budget and the actual results. It makes absolutely no sense to create a budget if the institution is not going to monitor results against it. The variances can point out corrective action that is required. These kids had so much fun on their mobile phones that they didn’t even look at their friends. On the other hand, technology became an essential part of our lives right now. Most of us spend time with our electronic devices that we forget where we were standing, what we were doing, or what is the purpose and objective of our life. What makes us addicted to mobile phones? Nowadays, we can do almost everything with our cellphones, such as playing videos games, accessing social networks, and watching videos online. These things have become too addictive to us, and we have spent so much time on such devices. Look back to 20 years ago, back when the time technologies were not very common compared to today. Eventually, we spent more time with each other; we hung out with friends. Technologies are advancing so rapidly that we have become addicted and have forgotten what surrounds us. Some people might argue that there is also a good side of technology advances. According to Dr. Rick Nauert, a Senior Editor of Psych Central, there was an unexpected discovery that playing video games helped human-beings reduce the production of the stress-related hormone cortisol (Psychcentral. com). In order to prove this, Dr. Nauert recorded a group of 23 newly recruited employees of a Montreal-based call center to play games. Later on, he found an amazing result that the games showed an average 17 percent reduction in cortisol production compared to the group who did not play games (Psychcentral. com). This showed that echnology advances can be applied for good purposes to our life. Although technologies help us to reduce the stress related hormone, it brings to us many health problems. Dr. Ripudaman, a master in science and a frequent computer user, claimed that there are heaths concerned when you sit and work in front of the computer for a long time, such as eyes problems from bright screen, and wrist ache after working at the computer all day (Ripudaman ). In addition, if we keep using the computer for a long time, these problems grow bigger. We might have joint problems, and our eyes have to work a lot so they get worse, in which case it costs us a lot of money for eyes and back surgery (Ripudaman). Another thing to be concerned about when we use technology is government censorship. You would feel bad if you lost your own privacy when the government tracked down your phone record, and eavesdropped on your phone call. This is the world when you need your own privacy, but most of our technological devices such as cellphones and laptops are tracked down by our own government every minute. According to Jennifer Valentino, the FBI was concerned by the citizens when they had the rights to access people’s phone record after the attack of September 11th, 2001 (Devries). Additionally, Professor Stephen Vladeck from American University Washington College of Law had put a good question to all of us; â€Å"How can you protect the First Amendment rights at the same time as you protect the government’s interest in secrecy? † (Vladeck). More importantly, no one among us would have see that our record had been tracked down, which should be a concern for an individual’s freedom. Others might claim that the government is doing the right thing in order to protect national security. By tracking down citizens’ record the government can easily find terrorists, who are trying to attack their country. After the incident on September 11th, the concerns over the government keeping track of people’s technological devices who they suspected as terrorists and a threat to the country (Vladeck). To answer for that, we should take China as an example; where the presses have been ranked as â€Å"not free† by Freedom House (Wikipedia. rg). In China, everything is monitored by the government mostly technological devices. We feel bad when our privacy are managed by the government. Therefore, these technology advances are not helping our life get better. Furthermore, technological advances help the government to access our privacy easily compared to our past 50 years. It leads us to a question, should we continue to use devices like cellphones, laptops or s martphone when the government is monitoring our activities through those devices? Lastly, technological advances can lead us to a world war. Countries with strong economies like the United States, China, and Russia always compete to have the strongest technologies for weapons in their hands. The rapid changes in technology help many countries in the world to create their own weapons, tanks, aircrafts, and nuclear bombs. Why are these countries are competing for war technology advances? Take a look at it this way, when a weapon or a bomb is created, it will be tested in Iraq or Afghanistan. There will be more deaths and bigger destruction as the technology of those weapons further advanced. The founder and leader of the Muttahida Quami Movement, Altaf Hussain, has brought us great attention to a possibility of a third world war, where these imperial powers continued to act in a presumptuous manner in world affairs (mqm. org). In fact, world powers countries should stop competing for war technologies advances with each other in the present world to make a better world, to bring peace to those countries whose need it. However, there are others who oppose that the United States and Russia are creating nuclear bombs and missiles defenses to protect their own national security. In reality, they are creating these defense systems to make other countries to be afraid of them. The more weapons and bombs created, the more deaths and destruction the world has to suffer. Instead of using billions and billions of dollars to make technological advances that kill people, we should use that huge amount of money to improve education, health care, and reduce the amount of starvation. There will be more people will feel happy as the government will use money to solve social and political problems. In general, by not using money to develop war technological advances, we can save a lot of lives, rather than killing them by weapons, bombs, and missiles and so on. In conclusion, technological advancement has seen many negative impacts on our society; it causes unhealthy addiction, encourages government censorship, and might lead to another destructive world war. We must stop using technology devices, we should stand together to stop these bad problems from our life. For the great future of our young generation, for the better living of our life, we must stop the bad effect of technologies on our life. Their profes sion demands them to work with fellow staffs in a way so that they can protect and promote health of the patients, families and also carers. Professionalism in nursing demands her to be honest with proper actions of integrity and disallowing any stigmas and discrimination within patients. Even his drinking habits are seriously criticized. This should be strictly avoided. APHRA believes that the nurses should practice in safe and competent manner maintaining the standards of professional and broad health system and maintaining relevant laws accordingly. They should also respect ethnicity, dignity, cultures, values and believes of proper caring maintain complete privacy and confidentiality of patients ("New-Code-of-Professional-Conduct-for-Nurses", 2017). Promoting trust and privilege among patient nurse relationships is very necessary along with developing confidence among them. They should also try to reflect on their practices so that they can determine their skill in maintaining the profession. She should portray correct organizational skills, stress management, be kind and compassionate, and have dedication and patience with excellent communication skills. That same week I graduated from Santa Barbara High School. I turned eighteen and went down to the DMV and passed my driver license exam and was given my first used car. It was one of those very first Hondas they made, so small; it had a motorcycle engine or a lawn mower motor. I dont know much about cars but I think someone told me it was a 2-cylinder engine and the car was so tiny that if I hung my arm out the driver window my knuckles scraped along the road. I hadnt needed a license before that because we lived right next to the High School right there on Nopal Street, and my parents taught me how to drive in the school parking lot. I got a 99 on the driver test and passed with flying colors my first time out. I didnt ask the DMV examiner why I missed that one point, but I think it was because I picked my nose at the last intersection. Im not a perfectionist so I didnt insist on taking the test again. Are you crazy? I was f ree now! Well, sort of. Even thought my parents had given the car to me and paid for it (I think it cost $350) they were kind of sending me mixed signals. I mean, they bought it for me because they wanted me to be have freedom and independence and lots of fun right? Or did they give it to me to drive away forever? I recall my mother always telling us that when you kids are eighteen youre on your own. I thought she meant it, you know, figuratively. But thats literally what happened. You see the plans for college fell through at the end of my senior year, primarily because I gave up on the whole idea. Now I just had a part-time job working at the local ice cream shop. I had a position as a soda jerk. When I got hired a couple years later at a hotel, the interviewer looked over my resume and he said hed never heard anyone refer to himself as a soda jerk. I didnt answer, but he chuckled and gave me the job anyway. You know when you go to an interview and they say, name three words to describe yourself? Im still laughing now, imagining my mom driving to the supermarket with a case of empty beer bottles clanking around and enfumed by the odor of stale alcohol. It would have been real funny if she got pulled over. What would she have told the officer? Needless to say, I had a typical amount of contempt most kids that age have for their parents and I was pushing the limits to all degrees. Again, psychologically speaking, it was probably a self-fulfilling and unconscious act.
